Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the website at thehomeremodelingcenter.com (the “Site”) and the services offered through it (collectively, the “Services”), operated by The Home Remodeling Center, LLC (“HRC”, “we”, “us”, or “our”).
Please read these Terms carefully. They include a binding arbitration provision and a class-action waiver in the Dispute Resolution section that affect how disputes between you and HRC are resolved. By using the Services, you agree to those provisions.
1. Acceptance of These Terms
By accessing or using the Services — including by visiting the Site, submitting a service request, or speaking with one of our dispatchers — you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Services.
If you are using the Services on behalf of a business or other entity, you represent that you have authority to bind that entity to these Terms.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Services. The Services are intended for users located in the United States. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.
3. What HRC Does
HRC operates a lead-matching marketplace. We connect homeowners and other property owners seeking home-improvement, remodeling, or repair services (“Homeowners”) with independent third-party service providers who perform those services (“Contractors”).
When you submit a service request, our dispatchers may contact you by phone, text, or email to qualify your request, and we then share your request with up to three (3) Contractors in our network who serve your area and offer the service you need. From that point, you and the Contractor communicate and contract directly with each other.
4. HRC Is Not a Party to Your Project
This is the most important thing to understand about the Services:
HRC is a referral and matching service only. HRC does not perform, supervise, manage, or guarantee any construction, remodeling, repair, design, or other home-improvement work. HRC is not a contractor, general contractor, construction manager, or agent of any Contractor or Homeowner.
Any agreement for work is solely between the Homeowner and the Contractor. HRC is not a party to that agreement, does not set pricing, prepare estimates, perform the work, or control the schedule, quality, safety, materials, or outcome of any project.
HRC is not responsible for the acts, omissions, conduct, workmanship, licensing, insurance, or any property damage, personal injury, loss, delay, or dispute arising from or relating to work performed (or not performed) by any Contractor. You engage Contractors at your own risk.
You are responsible for evaluating any Contractor before hiring them — including independently verifying licensing, insurance, references, permits, and quotes — and for the terms of any agreement you enter into with a Contractor.
5. Submitting a Service Request
When you submit a service request, you agree to provide accurate, current, and complete information, including your name, phone number, email address, service location, and project details. You agree that we may share this information with Contractors and our service providers as described in these Terms and our Privacy Policy.
You agree not to submit a request unless you have a genuine interest in the requested service. You may not submit requests on behalf of another person without their permission, or submit false, duplicative, or fraudulent requests.
6. No Endorsement or Guarantee of Contractors
HRC may apply screening criteria to Contractors in our network — which can include checks of licensing, insurance, and business records — and we may remove Contractors based on performance or reviews. However:
- HRC does not endorse, recommend, or guarantee any Contractor.
- Screening is not a guarantee of a Contractor’s skill, quality, honesty, licensing status, insurance coverage, or fitness for your project.
- Licensing and insurance status can change at any time. You are responsible for confirming a Contractor’s current status before hiring them.
- Ratings, reviews, and statistics shown on the Site are provided for informational purposes and may not reflect every Contractor’s current standing.
7. Communications and TCPA Consent
By providing your phone number through the Services, you expressly consent to receive calls and text (SMS) messages from HRC, our affiliates (including our call-center partner CSC Solutions), our service providers, and the Contractors we match you with, at the number you provide. These calls and texts may be made using automated technology, including an automatic telephone dialing system and an artificial or pre-recorded voice, and may be for marketing purposes.
Consent is not a condition of purchasing any goods or services, but consent to be contacted at the number you provide is necessary for HRC to perform the matching service you are requesting. Standard message and data rates may apply. You may opt out of texts by replying STOP. Full details are set out in our Privacy Policy.
8. Fees
Use of the Services to request a Contractor match is free for Homeowners. HRC is compensated by Contractors who pay for qualified leads. Any work you contract for with a Contractor is paid directly to that Contractor on terms you agree with them — HRC does not collect payment for, finance, or guarantee that work. Contractors who join the HRC network are subject to a separate agreement governing fees and lead delivery.
9. Acceptable Use
You agree not to:
- Use the Services for any unlawful, fraudulent, or deceptive purpose
- Submit false, inaccurate, or misleading information
- Impersonate any person or entity, or misrepresent your affiliation with anyone
- Harvest, scrape, or collect information about other users or Contractors
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services or related systems
- Introduce viruses, malware, or other harmful code
- Use automated means to access the Services except as permitted by our robots.txt
- Copy, reproduce, or create derivative works of the Site or its content except as expressly permitted
- Use the Services to send spam or unsolicited communications
- Violate any applicable law or the rights of any third party
10. User Content
The Services may allow you to submit content such as reviews, ratings, comments, photos, or feedback (“User Content”). You retain ownership of your User Content, but you grant HRC a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, and display that User Content in connection with operating and promoting the Services.
You represent that you own or have the necessary rights to your User Content and that it does not violate any law or third-party right. HRC may, but is not obligated to, review, screen, or remove User Content at its discretion.
11. Intellectual Property
The Site and its content — including text, graphics, logos, the HRC name and marks, design, layout, and software — are owned by or licensed to HRC and are protected by intellectual property laws. HRC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial purpose of seeking home-improvement services. You may not use the HRC name, logo, or marks without our prior written permission.
12. Third-Party Links and Services
The Services may contain links to third-party websites, services, or resources, including Contractor websites. HRC does not control and is not responsible for third-party content, products, services, or privacy practices. Links do not imply endorsement.
13. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, HRC disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
HRC does not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that the Services are free of viruses or other harmful components.
HRC makes no warranty regarding any Contractor, the quality, safety, legality, or timeliness of any work performed by a Contractor, or any results you may obtain from using the Services.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
14. Limitation of Liability
To the fullest extent permitted by law, HRC and its officers, directors, employees, affiliates, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Services, your dealings with any Contractor, or any work performed or not performed by a Contractor.
To the fullest extent permitted by law, the total aggregate liability of HRC arising out of or relating to these Terms or the Services will not exceed the greater of (a) the total amount you paid to HRC, if any, in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you.
15. Indemnification
You agree to defend, indemnify, and hold harmless HRC and its officers, directors, employees, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Services; your violation of these Terms; your violation of any law or the rights of any third party; your User Content; or any dispute or transaction between you and a Contractor or any other user.
16. Termination
HRC may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. You may stop using the Services at any time. Provisions that by their nature should survive termination will survive.
17. Dispute Resolution & Arbitration
Please read this section carefully. It affects your legal rights, including your right to file a lawsuit in court and to have a jury trial.
Informal Resolution First
Before filing a claim, you agree to first contact HRC at legal@thehomeremodelingcenter.com and attempt to resolve the dispute informally. You and HRC agree to negotiate in good faith for at least sixty (60) days before initiating arbitration.
Binding Arbitration
Except as set out below, any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved by binding individual arbitration, rather than in court. The arbitration will be administered by a recognized arbitration provider under its consumer arbitration rules. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class-Action Waiver
You and HRC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
Exceptions and Opt-Out
Either party may bring an individual claim in small-claims court if it qualifies, and either party may seek injunctive relief in court to protect intellectual property rights. You may opt out of this arbitration agreement by sending written notice to legal@thehomeremodelingcenter.com within thirty (30) days of first accepting these Terms, including your name, the phone number and email associated with your use of the Services, and a clear statement that you wish to opt out.
18. Governing Law
These Terms and any dispute arising out of them are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Subject to the Dispute Resolution section, any dispute not subject to arbitration will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to the jurisdiction of those courts.
19. Changes to These Terms
We may modify these Terms from time to time. When we do, we will update the “Last Updated” date above. If the changes are material, we will provide additional notice. Your continued use of the Services after the updated Terms take effect constitutes acceptance of the changes.
20. General Provisions
These Terms, together with the Privacy Policy, are the entire agreement between you and HRC regarding the Services and supersede all prior agreements on that subject. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will remain in force. HRC’s failure to enforce any provision is not a waiver. You may not assign these Terms without HRC’s consent; HRC may assign them without restriction. HRC is not liable for any delay or failure to perform resulting from causes beyond its reasonable control. Nothing in these Terms creates a partnership, joint venture, employment, agency, or franchise relationship.
